Notice of the Central Commission for Discipline Inspection and the Ministry of Supervision on discipline inspection organs using the measures of ‘liangzhi’and ‘lianggui’in accordance with the law

The stipulation of article 20 paragraph (3) of the Law on Administrative Supervision of the People's Republic of China 'order personnel suspected of having violated administrative discipline to provide a justification and an explanation of matters under investigation at a designated time and place but detention or disguised detention must not be enforced on them' (i.e. 'liangzhi') and the stipulation of article 28 paragraph (3) of the Provisions on Chinese Communist Party Discipline Inspection Organs' case inspection work 'request relevant personnel to provide an explanation of matters involved in the case at a stipulated time and place' (i. e. 'lianggui') are necessary measures stipulated by state law and Party rules whereby discipline inspection organs investigate and handle party discipline and administrative discipline cases. Practice proves how a correct adoption of these measures plays an extremely important role in cracking cases, and [these measures] shall continue to be adopted in accordance with the law. Currently, the circumstances under which discipline inspection  organs at each level adopt the measures of 'liangzhi' and 'lianggui' are on the whole good. At the same time, some problems that cannot be ignored exist. 

To guarantee a correct adoption of these measures by discipline inspection organs, further strengthening the work of investigating and handing cases, preventing the occurrence of violations of discipline and the law, the following provisions have been specially made: 

1.  The use of judicial means is not allowed. The use of judicial organs' office buildings, detention facilities and administrative departments' shelter and deportation facilities is not allowed. 

2. It is not allowed to build facilities dedicated to the adoption of 'liangzhi' and 'lianggui'.

3. It is forbidden to extort confessions, lure confessions. It is forbidden to use corporal punishments or disguised corporal punishments. It is forbidden to beat and scold, humiliate the person, and use tools of restraint.


Party discipline inspection organs at each level must strictly abide by the above-mentioned provisions. Circumstances and problems [arising] during enforcement must be promptly reported to the Central Discipline Commission and the Ministry of Supervision.
